ICJ will deliver verdict on Kulbhushan Jadhav today

The International Court of Justice (ICJ) in The Hague will deliver its verdict in a case related to the Indian national Kulbhushan Jadhav. Pakistani Military Court had given death sentence to Kulbhushan Jadhav based on an "extracted confession" but it was questioned by India in ICJ.

Kulbhushan Jadhav was sentenced to death in a three month long court trial on April 10, 2017. According to the Pakistani Court, Jadhav is accused of spying and his alleged links to India’s external intelligence agency, Research and Analysis Wing (R&AW).

Case of Kulbhushan Jadhav

•    Kulbhushan Jadhav was arrested by the Pakistan military in March 2016 on the Iran border. He was charged with terrorism, espionage and sabotage by the counter-terrorism court in Quetta.
•    After his arrest Pakistan released a confessional video in which he was identifying himself as an Indian Naval officer.
•    Government of India acknowledged him as retired Naval officer but denied any present connection with government agencies.
•    In April 2017 Pakistani military’s media wing, Inter Services Public Relations (ISPR), said that the death sentence handed out to Jadhav.
•    Kulbhushav Jadhav was tried under Section 59 of the Pakistan Army Act, 1952, and Section 3 of the Official Secrets Act, 1923.
•    India on May 8, 2017 filed a petition in the ICJ. India said Pakistan had violated the Vienna Convention and Jadhav had been illegally detained.
•    In June 2017, Kulbhushan Jadhav filed a mercy petition before Army Chief General Qamar Javed Bajwa. Pakistani authorities allowed his mother and wife to meet him on humanitarian grounds.
•    After hearing both sides, ICJ stayed the execution of Kukbhushan Jadhav.

India’s status in ICJ

In international court of justice India’s side is much cleared as Pakistan has intentionally and deliberately violated article 36 of Vienna convention by denying consular access to Kulbhushan Jadhav. He was never informed about exact charges. That is why ICJ has granted stay on execution of death penalty. United Nations can compel the order of ICJ to implement. ICJ order can be in favor of India because Pakistan has violated article 36 of Vienna convention.
