Delhi Government approves proposal delinking Aadhaar and social welfare benefits

The Delhi government on July 31, 2018 approved a proposal of its Social Welfare Department to do away with the requirement of linking the 12-digit Aadhaar number with bank accounts to avail the benefits of welfare schemes including old age, disability and widow pensions.

The Social Welfare department will now remit all the pensions stopped due to lack of Aadhaar linkage. The increased pension will be remitted with effect from April 2018, to all beneficiaries who are getting the pension on old rates so that beneficiaries are not penalised for system related reasons.

Benefit of ambiguity in tax exemption notification must be in state’s favour: SC

The Supreme Court of India on July 31, 2018 held that the benefit of any ambiguity in notification related to tax exemptions must be interpreted in favour of the State thus, overruling its 21-year-old verdict.

The constitution bench said that the benefit of ambiguity in tax exemption notification of the government, which is subject to strict interpretation, cannot be claimed by the assessee and should go in favour of the revenue/ state.

It ruled that the exemption notification should be interpreted strictly and the burden of proving the applicability of benefit would be on the assessee to show that his/her case comes within the parameters of the exemption clause or exemption notification.

Health Ministry signs MoU with Ministry of Electronics to facilitate access to Ayushman Bharat

The National Health Agency (NHA), under Ministry of Health and Family Welfare on July 31, 2018 signed a Memorandum of Understanding (MoU) with the Common Service Centres (CSC) scheme under the Digital India Programme.

The MoU was signed with an aim to provide information and eligibility validation services to beneficiaries of the Ayushman Bharat-National Health Protection Mission (AB-NHPM), especially in remote areas. This integration will not only create more accessibility and transparency in the beneficiary validation process, but will also spread awareness among the targeted beneficiaries.

Assam-NRC Draft can’t be basis of any action by any authority: SC

The Supreme Court on July 31, 2018 ruled that the National Register of Citizens (NRC) prepared for State of Assam was only a draft, and hence it cannot be the basis of any action by any authority against anyone.

The Court passed the order following the increasing concerns about the exclusion of approximately forty lakh persons from the final draft list of NRC that was published on July 30, 2018.

Lok Sabha passes Insolvency and Bankruptcy Code (Second Amendment) Bill, 2018

The Lok Sabha on July 31, 2018 passed the Insolvency and Bankruptcy Code (Second Amendment) Bill, 2018. The Bill was introduced in the parliament on July 23, 2018.

The Bill seeks to replace the Insolvency and Bankruptcy Code (Amendment) Ordinance 2018. It amends the Insolvency and Bankruptcy Code, 2016 to clarify that allottees under a real estate project should be treated as financial creditors.

It also allows the withdrawal of a resolution application submitted to the National Company Law Tribunal (NCLT) under the Code.  This decision can be taken with the approval of 90 percent of the committee of creditors.
